Customer Terms and Conditions

Please read these terms and conditions carefully before using the www.mangusahypermarket.com website. To be able to have access to the services on this website, the acceptance and compliance of these terms and conditions is vital. These terms and conditions apply to all visitors or users who access the services provided on the online shop. If you disagree with these terms and conditions, the website will not be available for access. By using the services provided by the website, you agree unconditionally with these terms and conditions.

1.1 Images and Design

Any designs or images produced by Mangusa Hypermarket B.V. for the customer will remain the intellectual property of Mangusa Hypermarket B.V. and may not be used in any other way, shape, or form without a written consent from Mangusa Hypermarket B.V. prior to using it. Customers may store, print, or display content only for their own personal use. Customers are not allowed to publish, distribute, manipulate, or reproduce, in any form, content or images provided on the website, nor use such content for any connections to business or commercial purposes.

1.2 Limitation of Liability

In no event shall Mangusa Hypermarket B.V. or its directors and employees or any independent contractor working for or on behalf of Mangusa Hypermarket B.V., be liable to the website user (customer) in regards to the use of the website, content, or images or any damages that can result from mistakes, omissions, deletion of files, errors, defects, or viruses. Mangusa Hypermarket B.V. is not in any way and under no circumstance responsible for delays in operations regarding to performance, whether resulting from force majeure (unforeseeable circumstances or act of god), failure in communication, theft, destruction, or unauthorized access to the records, programs, or services of Mangusa Hypermarket B.V. The user’s (customer) only remedy or solution is to stop using the website. The user will have no right whatsoever to file a claim against Mangusa Hypermarket B.V., its directors and employees and/or independent contractors working for or on behalf of Mangusa Hypermarket B.V. and/or will desist unconditionally of such a right/claim.

1.3 Returns

Refunds and return of goods are possible within three (3) days after date of receipt. Returns and refunds should be claimed with an actual receipt provided by the customer via email, Facebook, or personal visit to the hypermarket. Refunds are only provided in cash in-store.

Notwithstanding the abovementioned, Mangusa Hypermarket B.V has the right to refuse a return or refund whenever she has a valid reason for this refusal.

1.4 Tip

By making the purchase order online, the customer agrees to paying for the goods listed plus the tip. The customer agrees that the tip must be paid according to the number of items purchased:

  • 1-12 items = minimum of 5 guilders
  • 13-35 items = minimum of 10 guilders
  • 36-60 items= minimum of 15 guilders
  • 61-80 items= minimum of 20 guilders
  • 81-100 items= minimum of 25 guilders

1.5 Inventory (Supplies)

The products that are available for purchase on the online store (website) are only available if the products are available in the physical store or warehouse, in other words, products that are available on the website are available in store while supplies last. In some cases, products that are on sale on the website may not be on sale in store, or vice versa. The same terms apply for coupon codes, etc.

1.6 Prices and Payment

All prices on the website are in guilders. Payments can be done directly online or on location during the pick-up period. Cash is not allowed during this process. Customers that wish to pay directly online, can do so with a credit or debit card. The exchange rate of one (1) US dollar = 1,75 guilders is applicable. Bank Cards such as Maestro, Kompa Leon, Visa, Master Card, American Express etc. can only be used as a payment method.

Prices do not include delivery cost, service fees, or tips. Delivery costs, service fees, and tips will be added (at the appropriate cost shown) to the total amount due in the check-out section of the order, when the customer has chosen the desired method (delivery or pick-up).

Prices and other costs (delivery cost, service fee, or tips) are liable to change at any time without previous consent with the customer. This change will not affect orders that have already received a dispatch confirmation.

1.7 Taxes (OB)

All prices include taxes (OB) according to the category of 0% (water, bread etc.), 6% (canned products, chips, juices, candy etc.), or 9% (soda, alcohol, energy drink, etc.). For more information regarding tax laws in Curaçao, the client can visit www.gobiernu.cw

 

1.8 Service Fee

The customer understands that a service fee can be applied to the total sum of purchase (before tip and delivery fee). **This is not applicable during COVID-19 period.

1.9 Time Frame

The customer complies to their selected pick-up date and time.

Orders will be automatically canceled within two (2) hours after selected pick-up time chosen by the customer.

Customers must contact Mangusa Hypermarket at 526-9737 or 525-9737 if pick-up date and time should be adjusted 30 minutes (by the latest) before initial pick-up date and time.

Order ID and verification number must always be kept at hand to show designated employees that the customer has an online order.

1.10 Weighted products

Products that must be weighted include vegetables, fruits, nuts, meat, fish and salads. These items are selected upon 500 grams for fruits, vegetables, fish, and meat and 250 grams for salads and nuts. The picture illustrates approximately how many of these items are equivalent to the grams mentioned above. Item count may vary depending on the weight of the product.

Products that must be weighted include vegetables, fruits, nuts, meat, fish and salads. These items are selected upon how many kilos the customer wants to purchase or how many pieces the customer wants to purchase, but those items are weighted and therefore the price will be zero (0) online and the real price will be stipulated on a separate receipt.
